1. Preamble

Yoldago Ltd ("Yoldago", "we", "us", or "our") is a company registered in England and Wales (registered address: 167-169 Great Portland Street, 5th Floor, London, W1W 5PF, United Kingdom). Yoldago operates an online marketplace platform accessible via our website and mobile applications (collectively, the "Platform") that connects individuals who wish to request products from abroad ("Shoppers") with individuals who are travelling internationally and willing to bring such products ("Travelers").

Yoldago is a marketplace intermediary only. We do not buy, sell, offer, transport, or distribute any products on the Platform. We do not act as a retailer, distributor, or carrier of any goods. All agreements for the purchase and delivery of products are made solely between Shoppers and Travelers. Yoldago is not a party to any such agreement.

All payments on the Platform are processed by Stripe Technology Europe Limited, an authorised payment institution regulated by the Central Bank of Ireland. Yoldago is not a payment institution, payment service provider, or money transmitter. Yoldago does not hold, transfer, or transmit funds on behalf of any user.

By accessing or using the Platform — whether or not you have registered an account — you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and all documents incorporated herein by reference, including our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.

2. Eligibility

You may only register for and use the Platform if you meet all of the following conditions:

(a) You are at least 18 years of age;
(b) You have the legal capacity to enter into binding contracts under the laws applicable to you;
(c) You are not prohibited from using the Platform under any applicable law or regulation;
(d) You are not a person with whom Yoldago is prohibited from doing business under applicable sanctions, export control laws, or other regulations;
(e) All information you provide during registration and throughout your use of the Platform is accurate, complete, and up to date.

By registering an account, you represent and warrant that you meet all of the above conditions. If you no longer meet any of these conditions at any time, you must immediately cease using the Platform and notify us at info@yoldago.com.tr.

If you register on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and all references to "you" in these Terms shall refer to that entity.

3. Definitions

For the purposes of these Terms, the following terms shall have the meanings set out below:

"Platform" means the Yoldago website, mobile applications, and all related services operated by Yoldago Ltd.

"Member" means any individual who has registered an account on the Platform, including both Shoppers and Travelers.

"Shopper" means a Member who submits a product request on the Platform and seeks to have that product purchased and delivered by a Traveler.

"Traveler" means a Member who is travelling internationally and who agrees to purchase and deliver a requested product to a Shopper in exchange for an agreed fee.

"Deal" means the agreement reached between a Shopper and a Traveler regarding the product, price, Traveler Fee, and delivery details.

"Trip" means the travel itinerary published by a Traveler on the Platform, including origin, destination, and travel dates.

"Payment Hold" means the temporary holding of a Shopper's payment by Stripe under its delayed payout feature, pending confirmation of delivery via the Delivery Code, after which funds are transferred to the Traveler's account balance.

"Delivery Code" means the unique, single-use numeric code generated by the Platform and provided to the Shopper, which must be shared with the Traveler upon receipt of the product to confirm delivery and release payment.

"Traveler Fee" means the amount agreed between the Shopper and Traveler as compensation for the Traveler's services, in addition to the product purchase price.

"Service Fee" means the commission charged by Yoldago on each completed transaction, as further described in Section 10.

"Prohibited Products" means any products listed in Section 12 of these Terms, the transport or trade of which is restricted or prohibited under applicable law or these Terms.

"Content" means any text, images, links, descriptions, reviews, or other material submitted by Members to the Platform.

"Stripe" means Stripe Technology Europe Limited, the authorised payment institution that processes all payments on the Platform.

"Platform Content" means all content made available by Yoldago through the Platform, whether owned by Yoldago or licensed from a third party (excluding Member Content).

"Member Content" means any content submitted, uploaded, posted, or transmitted by a Member through the Platform.

"Aggregate Content" means Platform Content and Member Content collectively.

"Taxes" means any sales tax, value added tax (VAT), goods and services tax, customs duties, tariffs, withholding tax, personal or corporate income tax, or any other similar direct or indirect taxes or levies applicable to a transaction.

4. Account Registration

To access and use the full features of the Platform, you must create an account. By registering, you agree to the following:

(a) Registration Information
You must provide accurate, complete, and up-to-date information during registration, including your full name, email address, and any other information reasonably requested by Yoldago or Stripe. You are responsible for keeping your information current at all times.

(b) Account Security
You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You must not share your account with any third party. You are fully responsible for all activities that occur under your account. If you become aware of any unauthorised use of your account, you must notify us immediately at info@yoldago.com.tr.

(c) One Account Per Person
Each individual may only maintain one active account on the Platform. Creating multiple accounts to circumvent a suspension or for any other purpose is strictly prohibited and may result in permanent termination of all associated accounts.

(d) Dual Role
A Member may use the same account to act as both a Shopper and a Traveler. Switching between roles does not require a separate account.

(e) Account Updates
You may review, update, or delete your personal information at any time through your account settings. If you wish to permanently delete your account, you may submit a request to info@yoldago.com.tr. Account deletion requests will be processed in accordance with our Privacy Policy. Please note that accounts with active orders cannot be deleted until all pending transactions have been completed or cancelled.

(f) Accuracy of Information
Yoldago reserves the right to suspend or terminate any account where the information provided is found to be false, misleading, or incomplete.

(g) Content Following Account Cancellation
Please note that even upon cancellation of your account, any content you have submitted to the Platform — including but not limited to reviews, product requests, messages, and listing information — may continue to be displayed on the Platform in association with your username. Yoldago has no obligation to remove or return such content to you.

(h) Response to Security Breaches
If you become aware of or suspect any unauthorised use of your account, or any known or suspected security breach, you must notify Yoldago immediately at info@yoldago.com.tr. Yoldago will take prompt action to prevent or disable any unauthorised use and may, depending on the circumstances, permit you to open a new account.

5. How the Platform Works

Yoldago operates as an online marketplace that facilitates connections between Shoppers and Travelers. The following describes the standard flow of a transaction on the Platform:

(a) Step 1 — Shopper Creates a Request
The Shopper searches for a product or submits a product request on the Platform by providing the product name, description, link, and any other relevant details. The Shopper publishes the request so that it is visible to Travelers.

(b) Step 2 — Traveler Makes an Offer
A Traveler who has an upcoming trip matching the Shopper's request may make an offer. The Platform may suggest a recommended Traveler Fee based on the product value; however, the Traveler may propose a different fee. The Shopper may accept or decline any offer. All negotiations take place within the Platform.

(c) Step 3 — Deal is Confirmed and Payment is Made
Once the Shopper and Traveler agree on the product price, Traveler Fee, and delivery details, the Shopper makes payment to Stripe via the Platform. The Shopper's payment is subject to a Payment Hold until delivery is confirmed. Only after payment is confirmed by Stripe may the Traveler proceed to purchase the product.

(d) Step 4 — Traveler Purchases the Product
After receiving confirmation that the Shopper's payment has been processed, the Traveler purchases the product using their own funds. The Traveler is solely responsible for the purchase, including selecting the correct product, verifying its condition, and ensuring it complies with all applicable laws and customs regulations.

(e) Step 5 — Delivery and Confirmation
The Traveler delivers the product to the Shopper in person at an agreed location. Upon receipt, the Shopper shares the Delivery Code with the Traveler, who enters it into the Platform. This confirms delivery and releases the payment to the Traveler's account balance. The Shopper must not share the Delivery Code before receiving and inspecting the product.

(f) Platform as Intermediary
Yoldago's role is limited to facilitating the connection between Shoppers and Travelers and processing payments through Stripe. Yoldago is not a party to any Deal between a Shopper and a Traveler. Yoldago does not purchase, sell, transport, or guarantee any product listed or requested on the Platform. All transactions are entered into voluntarily and solely between Shoppers and Travelers.

(g) Multiple Orders
A Traveler may accept and fulfil multiple orders from different Shoppers within the same trip, provided that all orders comply with these Terms and applicable customs regulations.

(h) No Control Over Products
Yoldago has no control over and does not guarantee the existence, quality, safety, suitability, pricing, or legality of any product that is the subject of a Deal between Members. Yoldago makes no representations or warranties in this regard.

(i) COMPLIANCE WITH LAWS
BY ACCESSING OR USING THE PLATFORM, YOU ACKNOWLEDGE AND AGREE THAT IT IS SOLELY YOUR RESPONSIBILITY — AND NOT YOLDAGO'S — TO UNDERSTAND, COMPLY WITH, AND ADHERE TO ALL APPLICABLE LOCAL AND INTERNATIONAL LAWS AND REGULATIONS IN CONNECTION WITH ANY PRODUCTS, SERVICES, OR RELATIONSHIPS ARISING FROM YOUR USE OF THE PLATFORM.

6. Payment and Fund Management

(a) Payment Processing
All payments on the Platform are processed exclusively by Stripe Technology Europe Limited ("Stripe"), an authorised payment institution regulated by the Central Bank of Ireland. By using the Platform, you agree to Stripe's terms of service and privacy policy, available at stripe.com. Yoldago is not a payment institution, payment service provider, or money transmitter. Yoldago does not hold, transfer, or transmit funds on behalf of any user.

(b) How Payment Works
Once a Deal is confirmed, the Shopper makes payment in full to Stripe via the Platform. The Shopper's funds are held by Stripe under its delayed payout feature and will not be transferred to the Traveler until delivery is confirmed by the Shopper via the Delivery Code. Only after Stripe confirms successful processing of the Shopper's payment may the Traveler proceed to purchase the product.

(c) Payment Currency
All transactions on the Platform are processed in Euros (EUR). Payments made by card in other currencies will be converted to EUR by Stripe at the applicable exchange rate at the time of the transaction. Yoldago has no control over and accepts no responsibility for exchange rates or currency conversion fees applied by Stripe or the Shopper's card issuer.

(d) Delayed Payout — How Funds Are Held
Upon successful payment by the Shopper, Stripe holds the funds using its delayed payout feature, pending confirmation of delivery. This protects both parties: the Shopper's funds are not released until the Shopper confirms receipt by sharing the Delivery Code, and the Traveler may only purchase the product after the Shopper's payment has been successfully processed. The maximum duration for which funds may be held is 90 days, after which Stripe may release funds automatically in accordance with its own policies.

(e) Stripe Connected Account Agreement
Travelers who receive payments through the Platform must create a Stripe connected account and accept the Stripe Connected Account Agreement, available at stripe.com/legal/connect-account. By registering as a Traveler and receiving payments, you agree to be bound by the Stripe Connected Account Agreement as amended from time to time. Yoldago is not responsible for any acts or omissions of Stripe in connection with the processing of payments.

(f) Payment Security
Yoldago does not store, process, or have access to any card or banking details entered by users on the Platform. All such information is collected and stored solely by Stripe in accordance with applicable PCI DSS standards. Yoldago does not collect any financial data from users.

(g) Failed or Disputed Payments
If a payment fails or is disputed, Yoldago reserves the right to suspend the relevant transaction pending resolution. In the event of a chargeback or dispute initiated by the Shopper's card issuer, Stripe's dispute resolution process will apply. The Platform may hold or reverse funds in accordance with Stripe's policies. Yoldago reserves the right to recover any amounts owed as a result of disputed or fraudulent transactions.

(h) Stripe Reserves
Stripe may, at its discretion and in accordance with its policies, place a reserve on funds held in connection with your account. This may result in a temporary delay in the release of funds. Such reserves are outside Yoldago's control, and Yoldago will notify affected users where reasonably practicable.

7. Traveler Earnings and Payout

(a) Traveler Balance
Upon successful delivery confirmation via the Delivery Code, the Shopper's payment — minus the applicable Service Fee — is credited to the Traveler's account balance on the Platform. This balance is held by Stripe in the Traveler's connected account and is visible to the Traveler via their Stripe account balance page.

(b) Requesting a Payout
Travelers may request a payout of their available balance at any time by initiating a transfer through the Platform to their linked bank account. Payouts are processed by Stripe and are subject to Stripe's payout schedule and policies. Yoldago does not control the timing of payouts once a transfer has been initiated.

(c) Payout Requirements
To receive payouts, Travelers must: (i) have completed Stripe's identity verification and KYC process, which is handled directly by Stripe; (ii) have linked a valid bank account or payment account capable of receiving international EUR transfers; (iii) have an available balance that meets or exceeds the minimum payout amount as displayed in the Platform.

(d) Supported Bank Accounts
Stripe payouts are supported to bank accounts located in Stripe-supported countries and regions. Travelers based in countries where direct Stripe payouts are not available are responsible for obtaining a compatible payment account. Yoldago may recommend services such as Grey (grey.co) as a potential solution for receiving international EUR transfers. However, it is the Traveler's sole responsibility to ensure their chosen account is compatible with Stripe payouts. Yoldago makes no representations or warranties regarding any third-party payment services.

(e) Payout Currency
Payouts are made in Euros (EUR). Any currency conversion from EUR to the Traveler's local currency is the sole responsibility of the Traveler and will be subject to the exchange rates and fees of the Traveler's bank or payment provider. Yoldago accepts no responsibility for currency conversion costs or exchange rate fluctuations.

(f) Payout Fees
Stripe charges a payout fee of 0.25% per payout, capped at a maximum of $25 per payout. This fee is deducted from the Traveler's payout amount by Stripe. Yoldago has no control over Stripe's fee structure, which may change from time to time.

(g) Minimum Payout Amount
The minimum payout amount will be displayed within the Platform. Yoldago reserves the right to set and adjust the minimum payout amount from time to time with reasonable notice to users.

(h) Deferred Payouts and Stripe Reserves
In certain circumstances, Stripe may delay or place a hold on payouts in accordance with its policies, including in cases of suspected fraud, elevated chargeback risk, or regulatory requirements. Such delays are outside Yoldago's control. Yoldago will notify affected Travelers where reasonably practicable.

(i) Inactive Balances
If a Traveler's account balance remains unclaimed for an extended period, Yoldago reserves the right to take reasonable steps in accordance with applicable law, including notifying the Traveler of the inactive balance.

(j) Negative Balances and Platform Recovery
Travelers are solely responsible for any negative balances arising in their Stripe connected accounts, including those resulting from chargebacks, disputed transactions, refunds, or fraudulent activity. Yoldago reserves the right to recover any amounts owed by a Traveler as a result of such negative balances. Yoldago may offset any outstanding amounts against future payouts or take such other steps as are permitted under applicable law and Stripe's policies.

(k) Traveler's Purchase Obligation
The Traveler is solely responsible for purchasing the requested product using their own funds. Yoldago does not advance, lend, or provide funds to Travelers for the purpose of purchasing products. If a Traveler is unable to purchase the product for any reason, they must cancel the order immediately in accordance with Section 9. Failure to do so may result in account suspension.

8. Delivery and Confirmation

(a) Delivery Method
All deliveries on the Platform are made in person. The Traveler and Shopper must agree on a mutually convenient meeting location and time for the handover of the product. Yoldago does not arrange, coordinate, or guarantee delivery logistics. Yoldago does not support postal or courier delivery at this time.

(b) Traveler's Delivery Obligation
The Traveler is responsible for delivering the correct product in the condition in which it was purchased. The Traveler must ensure the product matches the Shopper's request in terms of brand, model, size, colour, and any other specifications agreed upon in the Deal.

(c) Delivery Code
Upon payment confirmation, the Platform generates a unique, single-use Delivery Code and provides it to the Shopper. The Delivery Code is the sole mechanism for confirming delivery and releasing payment to the Traveler.

(d) Confirmation Process
Once the Shopper has received and inspected the product and is satisfied, the Shopper shares the Delivery Code with the Traveler. The Traveler enters the Delivery Code into the Platform. Upon successful entry of the correct Delivery Code, delivery is confirmed and the Shopper's payment is transferred to the Traveler's account balance.

(e) Shopper's Responsibility Regarding the Delivery Code
The Shopper must not share the Delivery Code with the Traveler before receiving and inspecting the product. By sharing the Delivery Code, the Shopper confirms that the product has been received and accepted. Yoldago shall have no liability for any losses arising from a Shopper sharing the Delivery Code prematurely or incorrectly.

(f) Failed or Missed Delivery
If the Traveler and Shopper are unable to meet at the agreed time and location, the parties must arrange a new meeting between themselves. If delivery cannot be arranged within a reasonable time, either party may contact Yoldago's support team. If the Traveler is ultimately unable to deliver the product, the Traveler must cancel the order in accordance with Section 9, and the Shopper will receive a full refund.

(g) Product Condition and Discrepancies
The Traveler is solely responsible for the condition of the product at the time of delivery. If the Shopper believes the product is incorrect, damaged, or does not match the agreed specifications, the Shopper should raise the issue with the Traveler directly at the time of delivery and before sharing the Delivery Code. Once the Delivery Code has been shared and delivery confirmed, Yoldago shall have no further obligation or liability in respect of the product.

(h) No Guarantee of Product Availability
Yoldago does not guarantee that any requested product will be available for purchase in the Traveler's location. If the Traveler is unable to find or purchase the requested product, the Traveler must notify the Shopper and cancel the order in accordance with Section 9.

(i) Ratings Following Delivery
Following successful delivery confirmation, both the Shopper and the Traveler will be invited to rate each other. Ratings must be honest, accurate, and based solely on the completed transaction. Fake, misleading, or retaliatory reviews are strictly prohibited and may result in account suspension.

9. Cancellation and Refunds

(a) General Principle
Yoldago operates a staged cancellation policy that reflects the different phases of a transaction. The rights and obligations of each party depend on the stage at which the cancellation request is made.

(b) Stage 1 — Before Payment
If the Shopper wishes to cancel after a Deal has been agreed but before payment has been made, the Shopper may cancel freely at any time with no charge or penalty.

(c) Stage 2 — After Payment, Before Traveler Purchases the Product
If the Shopper has made payment but the Traveler has not yet purchased the product, the Shopper may cancel the order and receive a full refund. The refund will be processed by Stripe and returned to the Shopper's original payment method. No cancellation fee applies at this stage.

(d) Stage 3 — After Traveler Purchases the Product
Once the Traveler has purchased the product using their own funds, cancellation by the Shopper is only possible with the Traveler's explicit consent. If both parties agree to cancel, Yoldago will facilitate the refund process. The parties are responsible for agreeing on any compensation to the Traveler for costs already incurred. Yoldago is not responsible for any losses incurred by the Traveler as a result of a cancellation at this stage.

(e) Stage 4 — After Delivery Confirmation
Once the Shopper has shared the Delivery Code and delivery has been confirmed, the transaction is complete and no cancellation or refund is available. The Shopper's sharing of the Delivery Code constitutes final acceptance of the product.

(f) Traveler-Initiated Cancellation — Product Not Found
If the Traveler is unable to find or purchase the requested product, the Traveler must notify the Shopper as soon as possible and cancel the order through the Platform. In this case, the Shopper will receive a full refund and no penalty will apply to the Traveler.

(g) Traveler-Initiated Cancellation — Other Reasons
If the Traveler cancels for any reason other than inability to find the product, the Shopper will receive a full refund. Repeated cancellations by a Traveler may result in account review or suspension.

(h) Right of Withdrawal — Consumer Contracts Regulations 2013
In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, Shoppers have the right to withdraw from the agreement within 14 days of payment without giving any reason, provided that the Traveler has not yet purchased the product. Once the Traveler has purchased the product, the right of withdrawal is limited as described in Stage 3 above. If the Shopper exercises their right of withdrawal, any refund due will be processed within 14 days of the cancellation request. If Yoldago fails to provide adequate cancellation information, the withdrawal period is automatically extended to 12 months in accordance with applicable law.

(i) Refund Processing
All refunds are processed by Stripe and returned to the Shopper's original payment method. Refunds will be processed within 14 days of the cancellation being confirmed. Stripe's transaction fees and Yoldago's Service Fee are non-refundable and will not be included in any refund amount.

(j) Platform-Initiated Cancellation
Yoldago reserves the right to cancel any transaction at any time if it suspects fraudulent activity, a breach of these Terms, or a violation of applicable law. In such cases, Yoldago will determine the appropriate refund outcome at its sole discretion.

(k) No Liability for Consequential Losses
Yoldago shall not be liable for any consequential, indirect, or incidental losses arising from a cancellation, including but not limited to travel costs, accommodation costs, or any other expenses incurred by either party in connection with a cancelled transaction.

10. Fees and Commission

(a) Service Fee
Yoldago charges a Service Fee of 1% on each completed transaction. The Service Fee is calculated on the total amount paid by the Shopper, including the product price and the Traveler Fee, and is deducted automatically by Stripe at the time of payment. The Service Fee is charged to the Shopper.

(b) No Fee for Travelers
Yoldago does not charge any fee to Travelers. Travelers receive the full agreed Traveler Fee minus Stripe's payout fee as described in Section 7(f).

(c) Stripe Transaction Fees
All payments are subject to Stripe's standard transaction processing fees, which are separate from and in addition to Yoldago's Service Fee. Stripe's fees are deducted automatically at the time of payment. Yoldago has no control over Stripe's fee structure, which may change from time to time. Current Stripe fees will be displayed transparently to the Shopper before payment is confirmed.

(d) Transparency and Drip Pricing
In accordance with applicable law, including the Digital Markets, Competition and Consumers Act 2024, all fees and charges payable by the Shopper — including the product price, Traveler Fee, Service Fee, and applicable Stripe transaction fees — will be displayed in full before the Shopper confirms payment. No hidden fees or charges will be applied after the Shopper has confirmed payment.

(e) Fee Changes
Yoldago reserves the right to change its Service Fee at any time. Any changes to the Service Fee will be communicated to users with at least 30 days' prior notice via email or in-app notification. Changes will not apply to transactions that are already in progress at the time the change takes effect.

(f) Non-Refundable Service Fee
The Service Fee is non-refundable under any circumstances. In the event of a cancellation at any stage, Stripe's transaction fees are also non-refundable. The Shopper acknowledges that the Service Fee is charged in consideration of Yoldago's platform services, which commence at the time of payment.

11. Referral Program

(a) How the Referral Program Works
Yoldago operates a referral program that allows existing Members to invite new users to join the Platform. When an existing Member ("Referrer") invites a new user ("Referee") and the Referee registers on the Platform using the Referrer's unique referral link or code, both parties may be eligible for a referral benefit as described in this Section.

(b) Referral Benefit — Zero Service Fee on First Transaction
Where a new Member registers on the Platform via a valid referral link or code, the Service Fee described in Section 10(a) will not apply to the first completed transaction involving that new Member, whether as a Shopper or as a Traveler.

(c) Eligibility Conditions
To qualify for the referral benefit, the following conditions must be met: (i) The Referee must be a genuinely new user who has not previously registered on the Platform; (ii) The Referee must register using a valid referral link or code provided by the Referrer; (iii) The referral benefit applies only to the first completed transaction; (iv) The referral link or code must not have been obtained through fraudulent, misleading, or automated means.

(d) Abuse of the Referral Program
Any attempt to abuse the referral program — including but not limited to creating multiple accounts to generate referral benefits, using automated systems to generate referrals, or misrepresenting a referral relationship — is strictly prohibited and may result in immediate account suspension and forfeiture of any referral benefits.

(e) Modification or Termination of the Referral Program
Yoldago reserves the right to modify, suspend, or terminate the referral program at any time with reasonable notice to users.

(f) No Cash Value
Referral benefits have no cash value and cannot be exchanged for cash, transferred to another user, or combined with other promotions unless expressly stated by Yoldago.

12. Prohibited Products

(a) General Prohibition
Members must not use the Platform to request, offer, purchase, transport, or deliver any product that is prohibited or restricted under applicable local, national, or international law in the country of origin, transit, or destination.

(b) Absolutely Prohibited Products
The following products are strictly prohibited on the Platform under any circumstances:

(i) Illegal drugs, narcotics, controlled substances, or any substances regulated under applicable law;
(ii) Prescription medications or pharmaceuticals without valid authorisation;
(iii) Weapons, firearms, knives, batons, spears, swords, or any other weapons;
(iv) Toy guns, replica firearms, pistols, or revolvers;
(v) Ammunition, explosives, or chemicals;
(vi) Counterfeit, pirated, or trademark-infringing goods of any kind;
(vii) Stolen goods or goods of unknown or suspicious origin;
(viii) Pornographic or obscene materials, publications, recordings, or software;
(ix) Unauthorised reproductions of copyrighted publications, video cassettes, compact discs, laser discs, recordings, or tapes;
(x) Live animals, insects, or endangered species or their by-products;
(xi) Toxic, hazardous, flammable, or radioactive materials, including aerosols and lithium batteries in quantities exceeding personal use limits;
(xii) Currency, banknotes, or negotiable instruments;
(xiii) Medical devices, instruments, contact lenses, or optometry products;
(xiv) Pharmaceuticals or medications of any kind;
(xv) Poisons or chemical substances;
(xvi) Body armour or bulletproof clothing;
(xvii) Chewing gum in all its forms;
(xviii) Certain food and agricultural products subject to customs or biosecurity restrictions;
(xix) Alcohol and tobacco products;
(xx) Products promoting hatred, discrimination, or violence against any individual or group;
(xxi) Any package or parcel not personally purchased by the Traveler;
(xxii) Listings or content promoting other marketplace platforms or competitor services;
(xxiii) Any product the transport or trade of which is prohibited by the laws of the country of origin, transit, or destination.

(c) Traveler's Responsibility
The Traveler is solely responsible for ensuring that any product they agree to transport complies with all applicable laws and customs regulations. Yoldago does not verify the legality of any product and accepts no liability in this regard.

(d) Shopper's Responsibility
The Shopper is solely responsible for ensuring that the product they request is legal to import and does not fall within any prohibited category. Yoldago does not verify the legality of any product request and accepts no liability in this regard.

(e) Platform Rights
Yoldago reserves the right to remove any product request or listing that it reasonably believes involves a prohibited product, and to suspend or terminate the account of any Member who violates this Section, without prior notice.

(f) No Liability
Yoldago shall not be liable for any losses, penalties, fines, or legal consequences arising from a Member's request for, purchase of, or transportation of any prohibited product.

13. User Conduct

(a) General Obligations
By using the Platform, each Member agrees to use it solely for lawful purposes and in accordance with these Terms.

(b) Prohibited Actions
Members must not:

(i) Create false, misleading, or deceptive product requests, listings, or communications;
(ii) Misrepresent their identity, qualifications, or intentions;
(iii) Use another Member's account or impersonate any person or entity;
(iv) Engage in any transaction outside the Platform with a user they have met through the Platform;
(v) Copy, reproduce, scrape, or systematically extract data from the Platform using automated tools;
(vi) Interfere with or disrupt the Platform's infrastructure, servers, or networks;
(vii) Attempt to gain unauthorised access to any part of the Platform or other Members' accounts;
(viii) Upload or transmit viruses, malware, ransomware, or any other harmful code;
(ix) Send unsolicited commercial messages or spam to other Members;
(x) Collect or store personal data about other Members without their consent;
(xi) Use the Platform for any commercial purpose not expressly permitted by these Terms;
(xii) Reproduce, modify, or distribute any Platform Content without Yoldago's prior written consent;
(xiii) Harass, threaten, abuse, or intimidate any other Member or Yoldago staff;
(xiv) Post or transmit any content that is defamatory, obscene, offensive, hateful, or discriminatory;
(xv) Engage in price manipulation or any conduct intended to artificially influence the Platform's pricing or matching system.

(c) Off-Platform Transactions
Members who use the Platform to connect with other Members and subsequently conduct transactions outside the Platform are in breach of these Terms. Yoldago reserves the right to permanently terminate the accounts of Members found to be engaging in off-platform transactions.

(d) Ratings and Reviews
All ratings and reviews must be honest, accurate, and based solely on the completed transaction. Fake, fabricated, incentivised, or retaliatory reviews are strictly prohibited. In accordance with the Digital Markets, Competition and Consumers Act 2024, Yoldago takes reasonable steps to ensure the authenticity of all reviews on the Platform.

(e) Reporting Violations
Members who become aware of any conduct that violates these Terms are encouraged to report it to info@yoldago.com.tr.

(f) Consequences of Breach
Any breach of this Section may result in immediate account suspension or permanent termination, removal of content, and where applicable, referral to law enforcement authorities.

14. Customs, Taxes and Import/Export

(a) User Responsibility
All Members are solely responsible for understanding, complying with, and adhering to all applicable customs, import, export, and tax laws and regulations in the countries of origin, transit, and destination. Yoldago does not provide customs or tax advice and accepts no responsibility for any customs duties, taxes, fines, penalties, or seizures arising from any transaction on the Platform.

(b) Traveler's Customs Obligations
The Traveler is solely responsible for: (i) Declaring all products at the relevant customs checkpoints upon arrival at the destination; (ii) Paying all applicable customs duties, tariffs, and import taxes; (iii) Ensuring that the products they carry comply with all import and export restrictions; (iv) Understanding the personal use exemptions applicable in the destination country; (v) Factoring all applicable customs duties and tax costs into the Traveler Fee when negotiating a Deal.

(c) Shopper's Obligations
The Shopper is solely responsible for ensuring that the product they request is legal to import and for including the cost of any applicable customs duties and taxes when agreeing on the total price of the Deal.

(d) VAT and Tax Refunds
Yoldago does not manage, process, or facilitate VAT refund claims. Travelers wishing to claim a VAT refund should refer to the official customs authority of the relevant country. Yoldago may provide links to official government resources for informational purposes only.

(e) No Tax Collection
Yoldago does not collect, withhold, or remit any taxes on behalf of any Member. Each Member is solely responsible for determining and fulfilling their own tax obligations.

(f) Customs Information Resources
Yoldago may provide links to official customs authority websites for informational purposes only. Such links do not constitute legal or tax advice. Examples of official customs resources include: European Union: ec.europa.eu/taxation_customs — United States: cbp.gov — United Kingdom: gov.uk/government/organisations/hm-revenue-customs — United Arab Emirates: customs.gov.ae

(g) No Liability
Yoldago shall not be liable for any losses, fines, penalties, seizures, or legal consequences arising from a Member's failure to comply with applicable customs, import, export, or tax laws and regulations.

15. Insurance and Liability for Goods

(a) No Insurance
Yoldago does not provide, arrange, or facilitate any insurance coverage for products requested, purchased, transported, or delivered through the Platform. No product carried by a Traveler is insured by Yoldago under any circumstances.

(b) Traveler's Liability for Goods
The Traveler is solely responsible for the safekeeping of any product from the time of purchase until delivery to the Shopper. If a product is lost, stolen, damaged, destroyed, or does not match the agreed specifications, the Traveler bears full responsibility. Yoldago shall have no liability whatsoever in respect of any such loss, damage, or discrepancy.

(c) No Platform Liability for Product Condition
Yoldago does not inspect, verify, or guarantee the condition, quality, authenticity, or fitness for purpose of any product transported through the Platform. Any dispute regarding the condition or quality of a product is solely between the Shopper and the Traveler.

(d) Shopper's Acknowledgement
By using the Platform, the Shopper acknowledges and accepts that: (i) Products are purchased and transported by Travelers who are private individuals, not professional retailers or couriers; (ii) Yoldago does not guarantee the availability, condition, authenticity, or timely delivery of any product; (iii) In the event of loss, damage, or non-delivery, the Shopper's recourse is against the Traveler and not against Yoldago; (iv) The Shopper is solely responsible for verifying the product before sharing the Delivery Code.

(e) Traveler's Acknowledgement
By accepting an order, the Traveler acknowledges and accepts that: (i) They are personally responsible for purchasing the correct product as specified in the Deal; (ii) They are responsible for ensuring the product is not damaged, opened, or tampered with during transport; (iii) Any loss or damage to the product during transport is their sole responsibility; (iv) They are not acting as a professional courier and Yoldago provides no insurance or indemnity for their activities.

(f) No Consequential Liability
Yoldago shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the loss, theft, damage, or non-delivery of any product.

16. Intellectual Property

(a) Yoldago's Intellectual Property
All Platform Content is owned by or licensed to Yoldago Ltd and is protected by applicable intellectual property laws, including the UK Copyright, Designs and Patents Act 1988. Nothing in these Terms grants any user a licence to use Yoldago's intellectual property except as expressly set out herein.

(b) Restricted Use
Members must not, without Yoldago's prior written consent, copy, reproduce, distribute, modify, frame, scrape, or use any Platform Content for commercial purposes outside of the Platform.

(c) Member Content Licence
By submitting any Member Content to the Platform, you grant Yoldago a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, publish, and display such content for the purposes of operating, improving, and promoting the Platform. This licence continues even if you close your account.

(d) Member Warranties Regarding Content
By submitting any Member Content, you represent and warrant that you own or have the necessary rights to submit the content, and that the content does not infringe any third party's rights or violate any applicable law.

(e) Third Party Intellectual Property
If you believe that any content on the Platform infringes your intellectual property rights, please contact Yoldago at info@yoldago.com.tr. Yoldago will investigate all notices and remove infringing content within 24 hours where reasonably practicable.

(f) Product Links and Third Party Content
Members may submit links to third-party websites when creating product requests. Yoldago is not responsible for the accuracy, legality, or availability of such content.

17. Third Party Services

(a) General
The Platform integrates with certain third-party services in order to operate. Yoldago is not responsible for the acts, omissions, or policies of any third-party service provider.

(b) Stripe
All payments on the Platform are processed by Stripe Technology Europe Limited. By using the Platform, you agree to be bound by Stripe's terms of service and privacy policy. Yoldago is not responsible for any failure, delay, error, or interruption in Stripe's services. The following paragraph is incorporated into this Section by reference, as required by Stripe:

"We use Stripe for payments, analytics, and other business services. Stripe may collect personal data including via cookies and similar technologies. The personal data Stripe collects may include transactional data and identifying information about devices that connect to its services. Stripe uses this information to operate and improve the services it provides to us, including for fraud detection, loss prevention, authentication, and analytics related to the performance of its services. You can learn more about Stripe and read its privacy policy at stripe.com/privacy."

(c) Stripe Connected Account Agreement
Travelers who receive payments through the Platform are required to accept the Stripe Connected Account Agreement, available at stripe.com/legal/connect-account. Yoldago is not responsible for Stripe's obligations thereunder.

(d) Analytics and Marketing Services
The Platform may use third-party analytics services, including Google Analytics and Google Firebase. These services may collect usage data in accordance with their own privacy policies.

(e) Communication Services
The Platform may use third-party email services, including Resend, to send transactional and marketing communications to users.

(f) Third Party Links
The Platform may contain links to third-party websites. Such links are provided for informational purposes only. Yoldago does not endorse or accept responsibility for any third-party website or its content.

(g) No Endorsement
The inclusion of any third-party service or link on the Platform does not constitute an endorsement or recommendation by Yoldago.

18. Privacy and Data Protection

(a) Privacy Policy
Yoldago collects, uses, and processes personal data in accordance with its Privacy Policy, which is incorporated into these Terms by reference and is available at yoldago.com/privacy.

(b) UK GDPR Compliance
Yoldago processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Yoldago is registered with the Information Commissioner's Office (ICO) [registration number to be inserted]. Users have the right to lodge a complaint with the ICO at ico.org.uk/make-a-complaint.

(c) Data Shared with Stripe
By using the Platform, you acknowledge that certain personal data will be shared with Stripe for the purposes of payment processing, fraud prevention, and identity verification.

(d) Data Shared Between Members
Certain personal data may be shared between Shoppers and Travelers to facilitate a Deal. Members must not use personal data shared through the Platform for any purpose other than completing the relevant transaction.

(e) User Rights
Users have the right to access, rectify, erase, restrict, port, and object to the processing of their personal data. To exercise any of these rights, users may contact Yoldago at info@yoldago.com.tr.

(f) Data Retention
Yoldago retains personal data for as long as necessary to provide the Platform's services and comply with applicable legal obligations. Upon account deletion, personal data will be retained for two years before being permanently deleted or anonymised.

(g) Cookies
The Platform uses cookies and similar tracking technologies in accordance with our Cookie Policy, available at yoldago.com/cookies.

(h) International Data Transfers
Personal data may be transferred to and processed in countries outside the United Kingdom. Any such transfers will be carried out using appropriate safeguards including standard contractual clauses or UK International Data Transfer Agreements (IDTAs).

19. Communication Consent

(a) Transactional Communications
By creating an account, you agree to receive transactional communications from Yoldago relating to your use of the Platform, including order confirmations, Delivery Code notifications, payment confirmations, and security alerts. Transactional communications are necessary for the operation of the Platform and cannot be opted out of while your account remains active.

(b) Marketing Communications
With your explicit prior consent, Yoldago may send you marketing communications via email, SMS, or in-app notifications. Marketing communications will only be sent where you have opted in.

(c) Opt-Out
You may withdraw your consent to receive marketing communications at any time by clicking the "Unsubscribe" link in any marketing email, updating your preferences in account settings, or contacting info@yoldago.com.tr.

(d) Compliance
All marketing communications comply with the UK Privacy and Electronic Communications Regulations (PECR) and the UK GDPR.

(e) Third Party Communications
Yoldago will not share your contact details with third parties for the purposes of direct marketing without your explicit prior consent.

20. Platform Warranties and Disclaimers

(a) PLATFORM PROVIDED "AS IS"
THE PLATFORM, INCLUDING ALL CONTENT, FEATURES, AND SERVICES, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOLDAGO EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

(b) No Warranty of Availability
Yoldago does not warrant that the Platform will be available at all times, uninterrupted, or error-free.

(c) No Warranty Regarding Members
Yoldago makes no representations or warranties regarding the reliability, honesty, or lawful conduct of any Member. Members interact with each other entirely at their own risk.

(d) No Warranty Regarding Products
Yoldago does not inspect, verify, or guarantee the existence, quality, safety, authenticity, legality, or fitness for purpose of any product on the Platform.

(e) No Warranty Regarding Third Party Services
Yoldago makes no representations or warranties regarding any third-party service integrated with the Platform, including Stripe.

(f) USER ACKNOWLEDGEMENT
BY USING THE PLATFORM, YOU ACKNOWLEDGE AND AGREE THAT: (I) YOLDAGO IS NOT A PARTY TO ANY AGREEMENT BETWEEN MEMBERS; (II) YOLDAGO DOES NOT PURCHASE, SELL, TRANSPORT, OR GUARANTEE ANY PRODUCT; (III) ALL RISKS ARISING FROM TRANSACTIONS ARE BORNE SOLELY BY THE RELEVANT MEMBERS; (IV) ANY OFFLINE MEETINGS BETWEEN MEMBERS ARE CONDUCTED ENTIRELY AT THEIR OWN RISK.

(g) No Endorsement of Member Content
Yoldago does not endorse, approve, or verify any Member Content submitted to the Platform.

21. Limitation of Liability

(a) MAXIMUM LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOLDAGO'S TOTAL LIABILITY TO ANY USER ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT OF SERVICE FEES PAID BY THAT USER TO YOLDAGO IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED POUNDS STERLING (£100), WHICHEVER IS GREATER.

(b) EXCLUSION OF CONSEQUENTIAL LOSS
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOLDAGO SHALL NOT BE LIABLE FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF YOLDAGO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(c) User Indemnity
Each Member agrees to indemnify, defend, and hold harmless Yoldago Ltd, its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses arising out of or relating to their use of the Platform, their Member Content, their breach of these Terms, or any dispute between Members.

(d) Exceptions
Nothing in these Terms shall limit or exclude Yoldago's liability for: (i) death or personal injury caused by Yoldago's negligence; (ii) fraud or fraudulent misrepresentation by Yoldago; (iii) any other liability that cannot be excluded under applicable law, including the UK Consumer Rights Act 2015.

(e) Essential Basis of the Agreement
The parties acknowledge that the limitations of liability set out in this Section reflect a fair and reasonable allocation of risk and are an essential element of the basis of the agreement between Yoldago and its users.

22. Account Suspension and Termination

(a) Termination by the User
You may close your account at any time by submitting a request to info@yoldago.com.tr. Accounts with active orders cannot be closed until all pending transactions have been completed or cancelled. Any available balance must be withdrawn prior to account deletion.

(b) Suspension or Termination by Yoldago
Yoldago reserves the right to suspend, restrict, or permanently terminate any account at any time, with or without prior notice, if Yoldago reasonably believes that a Member has violated these Terms, engaged in fraudulent or unlawful conduct, or been identified as a risk by Stripe.

(c) Effect of Suspension
During suspension, the affected Member will be unable to access the Platform, create new orders, or receive payments.

(d) Effect of Termination
Upon permanent termination, the Member's right to access the Platform ceases immediately, pending orders will be cancelled, and refunds processed in accordance with Section 9.

(e) Notification
Where reasonably practicable, Yoldago will notify the affected Member of a suspension or termination and the reason therefor.

(f) Appeals
A Member whose account has been suspended or terminated may submit an appeal to info@yoldago.com.tr within 14 days. Yoldago's decision on appeal is final.

(g) Survival
Sections 10, 15, 16, 18, 20, 21, 23, and 27 shall survive termination of these Terms or closure of a Member's account.

23. Dispute Resolution

(a) General Principle
Yoldago encourages all Members to attempt to resolve disputes amicably and directly with each other in the first instance.

(b) Disputes Between Members
Any dispute between a Shopper and a Traveler is solely between those Members. Yoldago is not a party to any such dispute but may, at its sole discretion, provide reasonable assistance to facilitate a resolution.

(c) Stage 1 — Platform Support
Before initiating any formal legal proceedings, Members must first contact Yoldago's support team at info@yoldago.com.tr. Yoldago will acknowledge all support requests within 48 hours and endeavour to provide a resolution within 14 days.

(d) Stage 2 — Formal Proceedings
If a dispute cannot be resolved through Stage 1 within 30 days, either party may pursue formal legal proceedings. For disputes involving amounts of £10,000 or less, the UK Small Claims Court provides a cost-effective mechanism. Information is available at gov.uk/make-court-claim-for-money.

(e) Disputes Between Members and Yoldago
Any dispute between a Member and Yoldago shall be notified in writing to info@yoldago.com.tr. Yoldago will respond within 14 days. If unresolved within 30 days, either party may refer the matter to the courts of England and Wales.

(f) Alternative Dispute Resolution
The European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.

(g) No Class Actions
All disputes must be brought on an individual basis. Members waive any right to bring claims as part of any class action or representative proceeding.

24. Force Majeure

(a) Definition
"Force Majeure Event" means any event beyond Yoldago's reasonable control that prevents or delays performance of its obligations, including acts of God, war, terrorism, pandemic, government action, infrastructure failure, cyberattacks, or failure of third-party services including Stripe.

(b) Effect of Force Majeure
If Yoldago is prevented from performing its obligations due to a Force Majeure Event, Yoldago will notify affected users as soon as practicable and use reasonable endeavours to resume normal operations.

(c) No Liability
Yoldago shall not be liable to any Member for any loss, damage, delay, or failure to perform arising from a Force Majeure Event.

(d) Prolonged Force Majeure
If a Force Majeure Event continues for more than 30 days, Yoldago reserves the right to suspend or terminate the affected services on reasonable notice to users.

25. Severability

(a) General
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be deemed severed to the minimum extent necessary. The remaining provisions shall continue in full force and effect.

(b) Modification of Invalid Provisions
Where a provision is found invalid but would be valid if modified, the parties agree it shall apply with the minimum modification necessary to make it valid.

(c) No Waiver
A failure or delay by Yoldago in exercising any right under these Terms shall not constitute a waiver of that right.

26. Amendments

(a) Yoldago's Right to Amend
Yoldago reserves the right to modify these Terms at any time. Users will be notified of material changes by email, in-app notification, and by posting the updated Terms with a revised "Last Updated" date.

(b) Notice Period
For material changes, Yoldago will provide at least 30 days' prior notice. Changes required by law or to address security vulnerabilities may take effect immediately.

(c) Acceptance of Amended Terms
Your continued use of the Platform after the effective date of any amendment constitutes acceptance of the amended Terms.

(d) No Retroactive Effect
Amendments will not apply retroactively to transactions already in progress, unless required by law.

27. Governing Law

(a) Applicable Law
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.

(b) Jurisdiction
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

(c) Consumer Rights
Nothing in this Section affects the statutory rights of consumers under applicable mandatory consumer protection laws.

(d) Language
These Terms are available in English and Turkish. In the event of any conflict between the English and Turkish versions, the English version shall prevail.

İşbu Şartlar'ın amaçları doğrultusunda temel tanımlar: "Platform" Yoldago web sitesi ve uygulamaları; "Üye" hesap oluşturmuş kullanıcı; "Alıcı" ürün talep eden Üye; "Yolcu" ürünü satın alıp getiren Üye; "Anlaşma" taraflar arasındaki mutabakat; "Teslimat Kodu" tek kullanımlık teslimat onay kodu; "Hizmet Ücreti" Yoldago'nun %1 komisyonu; "Yasaklı Ürünler" Madde 12'deki liste.

4. Hesap Kaydı

Platform'un tüm özelliklerine erişmek için hesap oluşturulması zorunludur. Kayıt bilgilerinin doğru ve güncel tutulması, hesap güvenliğinin korunması, kişi başına tek hesap kuralına uyulması ve güvenlik ihlallerinin derhal bildirilmesi zorunludur. Aynı hesapla hem Alıcı hem Yolcu olunabilir.

5. Platform Nasıl Çalışır?

(1) Alıcı ürün talebi oluşturur. (2) Yolcu teklif verir. (3) Anlaşma onaylanır ve Alıcı Stripe üzerinden ödeme yapar — para teslimat onaylanana kadar güvende tutulur. (4) Yolcu ürünü satın alır. (5) Yüz yüze teslimat gerçekleşir; Alıcı Teslimat Kodu'nu paylaşarak teslimi onaylar ve ödemenin serbest bırakılmasını sağlar. Yoldago'nun rolü yalnızca aracılıkla sınırlıdır.

6. Ödeme ve Fon Yönetimi

Tüm ödemeler Stripe tarafından işlenir. Alıcı'nın fonları, Teslimat Kodu aracılığıyla teslimat onaylanana kadar bekletilir. Maksimum bekleme süresi 90 gündür. Yolcular Stripe bağlı hesabı oluşturmak ve KYC doğrulamasını tamamlamakla yükümlüdür. Tüm işlemler Euro (EUR) cinsinden gerçekleştirilir. Yoldago finansal veri toplamaz.

7. Yolcu Kazançları ve Para Çekimi

Teslimat onaylandığında ödeme Yolcu'nun bakiyesine yansıtılır. Yolcu istediği zaman para çekimi talep edebilir. KYC Stripe tarafından gerçekleştirilir. Ödemeler EUR cinsindendir. Stripe payout ücreti %0,25'tir (maksimum $25). Türkiye gibi Stripe'ın doğrudan payout yapmadığı ülkelerde Grey (grey.co) gibi servisler önerilebilir. Negatif bakiyeler Yolcu'nun sorumluluğundadır.

8. Teslimat ve Onay

Tüm teslimatlar yüz yüze gerçekleştirilir. Teslimat Kodu yalnızca ürün teslim alındıktan sonra Yolcu ile paylaşılmalıdır. Teslimat Kodu paylaşılınca teslimat onaylanmış ve ürün kabul edilmiş sayılır. Ürün bulunamazsa Yolcu iptal eder ve Alıcı'ya tam iade yapılır.

9. İptal ve İade

Aşama 1 (ödeme öncesi): Ücretsiz iptal.
Aşama 2 (ödeme sonrası, Yolcu satın almadan önce): 14 gün içinde tam iade.
Aşama 3 (Yolcu satın aldıktan sonra): Yalnızca Yolcu'nun onayıyla iptal.
Aşama 4 (Teslimat Kodu paylaşıldıktan sonra): İptal ve iade hakkı yoktur.

Hizmet Ücreti ve Stripe işlem ücreti hiçbir aşamada iade edilmez. Alıcılar, Yolcu ürünü satın almadan önce 14 gün içinde cayma hakkını kullanabilir (Consumer Contracts Regulations 2013).

10. Ücretler ve Komisyon

Yoldago, tamamlanan her işlem üzerinden Alıcı'dan %1 Hizmet Ücreti alır. Yolculardan ücret alınmaz. Buna ek olarak Alıcı, ödeme sağlayıcısının (Stripe) işlem maliyetini karşılayan bir Ödeme İşlem Ücreti öder; bu ücret ödeme öncesinde ayrı bir kalem olarak şeffaf biçimde gösterilir. Hizmet Ücreti ve Ödeme İşlem Ücreti hiçbir koşulda iade edilmez. Ücret değişiklikleri 30 gün önceden bildirilir.

11. Referral Programı

Geçerli referral bağlantısı ile kaydolan yeni Üye'nin ilk tamamlanan işleminde %1 Hizmet Ücreti alınmaz. Programın kötüye kullanılması hesap kapatılmasına yol açar. Referral avantajlarının nakit değeri yoktur.

12. Yasaklı Ürünler

Yasadışı uyuşturucular, silahlar, sahte ürünler, reçeteli ilaçlar, pornografik materyaller, canlı hayvanlar, tehlikeli maddeler, döviz, tıbbi cihazlar, kontak lens, alkol ve tütün ürünleri, kurşun geçirmez giysi, sakız ve Yolcu tarafından bizzat satın alınmayan koliler kesinlikle yasaktır. 13. Kullanıcı Davranışı

Üyeler Platform'u yalnızca yasal amaçlar için kullanmalıdır. Yanıltıcı içerik, kimlik sahteciliği, platform dışı işlem, veri kazıma, sisteme yetkisiz erişim, spam gönderme ve taciz kesinlikle yasaktır. Tüm değerlendirmeler dürüst ve gerçek işlemlere dayalı olmalıdır.

14. Gümrük ve Vergiler

Gümrük beyanı, vergi ödeme ve mevzuata uyum tamamen kullanıcının sorumluluğundadır. Yoldago gümrük veya vergi tavsiyesi vermez ve bu konuda herhangi bir sorumluluk kabul etmez.

15. Sigorta ve Ürün Sorumluluğu

Yoldago hiçbir sigorta teminatı sağlamaz. Ürünün güvenli muhafazası satın alma anından teslimata kadar tamamen Yolcu'nun sorumluluğundadır. Ürün kaybolursa, hasar görürse veya yanlış gelirse sorumluluk Yolcu'ya aittir.

16. Fikri Mülkiyet

Tüm Platform İçeriği Yoldago'ya aittir. İzinsiz kopyalama, dağıtma veya ticari kullanım yasaktır. Üyeler gönderdikleri içerikler için Yoldago'ya kullanım lisansı verir. Telif hakkı ihlali bildirimleri 24 saat içinde değerlendirilir.

17. Üçüncü Taraf Hizmetler

Platform Stripe, Google Analytics ve Resend gibi üçüncü taraf hizmetleri entegre eder. Yoldago bu hizmetlerin arızasından sorumlu değildir. Yolcular Stripe Connected Account Agreement'ı kabul etmekle yükümlüdür.

18. Gizlilik ve Veri Koruma

Kişisel veriler UK GDPR ve Data Protection Act 2018 uyarınca işlenir. ICO kayıt numarası tescil tamamlandıktan sonra eklenecektir. Kullanıcılar erişim, düzeltme, silme ve itiraz haklarına sahiptir. Veri saklama süresi hesap kapatmadan sonra 2 yıldır.

19. İletişim Onayı

İşlemsel iletişimler (sipariş onayı, teslimat kodu, ödeme bildirimi) zorunludur ve devre dışı bırakılamaz. Pazarlama iletişimleri yalnızca açık onay ile gönderilir. İstediğiniz zaman abonelikten çıkabilirsiniz.

20. Platform Garantileri ve Feragatler

PLATFORM "OLDUĞU GİBİ" SUNULMAKTADIR. YOLDAGO TİCARİ ELVERİŞLİLİK, BELİRLİ BİR AMACA UYGUNLUK VE İHLAL ETMEMEYE İLİŞKİN TÜM GARANTİLERDEN FERAGAT EDER. YOLDAGO ÜYELER ARASINDAKİ HERHANGİ BİR ANLAŞMANIN TARAFI DEĞİLDİR VE HERHANGİ BİR ÜRÜNÜ SATIN ALMAZ, SATMAZ VEYA GARANTİ ETMEZ.

21. Sorumluluğun Sınırlandırılması

YOLDAGO'NUN TOPLAM SORUMLULUĞU, SON 3 AYDA ÖDENEN TOPLAM HİZMET ÜCRETİNİ VEYA £100'I AŞAMAZ. YOLDAGO KAR KAYBI, VERİ KAYBI VEYA DOLAYLI ZARARLARDAN SORUMLU DEĞİLDİR. İSTİSNALAR: İHMAL NEDENİYLE ÖLÜM/KİŞİSEL YARALANMA VE DOLANDIRICILIK.

22. Hesap Askıya Alma ve Fesih

Kullanıcı istediği zaman hesabını kapatabilir — aktif sipariş yoksa. Yoldago Şartlar ihlali, sahte faaliyet veya yasadışı davranış durumunda hesabı askıya alabilir veya kapatabilir. 14 gün içinde itiraz hakkı mevcuttur.

23. Anlaşmazlık Çözümü

Önce taraflar kendi aralarında çözmeye çalışır. Çözüme ulaşılamazsa info@yoldago.com.tr'a başvuru yapılır (48 saat yanıt, 14 gün çözüm hedefi). Hâlâ çözüme ulaşılamazsa £10,000'e kadar olan uyuşmazlıklar için UK Small Claims Court'a başvurulabilir.

24. Mücbir Sebep

Doğal afet, savaş, pandemi, hükümet eylemi, altyapı kesintisi veya Stripe dahil üçüncü taraf hizmet arızaları gibi Yoldago'nun kontrolü dışındaki olaylardan kaynaklanan gecikmeler veya aksaklıklar için Yoldago sorumlu tutulamaz.

25. Bölünebilirlik

Herhangi bir hükmün geçersiz bulunması halinde kalan hükümler geçerliliğini korur. Feragat etmeme hakkı saklıdır.

26. Değişiklikler

Yoldago Şartlar'ı istediği zaman değiştirebilir. Önemli değişiklikler için 30 gün önceden bildirim yapılır. Değişiklik sonrası Platform kullanımına devam etmek değişiklikleri kabul anlamına gelir.

27. Uygulanacak Hukuk

Bu Şartlar İngiltere ve Galler hukukuna tabidir. İngiltere ve Galler mahkemeleri münhasır yargı yetkisine sahiptir. İngilizce ve Türkçe versiyonlar arasında çelişki olması halinde İngilizce versiyon geçerlidir.
